Welcome to AmtekPro (www.amtekpro.com), a service provided by Amtek Information Service, Inc. These Terms of Service govern your use of AmtekPro and the services provided through it. By creating an account or accessing AmtekPro, you agree to be bound by these Terms of Service and all terms incorporated by reference, including the data use restrictions set forth herein. Your creation of an account constitutes your affirmative acceptance of these Terms. If you do not agree to these terms, you may not create an account or use AmtekPro.
In order to access and use AmtekPro, you will be required to create an account. You must provide accurate and complete information when creating your account, and you must keep your account information up-to-date going forward. You are solely responsible for all activities that occur under your account.
Each individual who uses AmtekPro must have their own unique account and login credentials. Each account is tied to a single physical office location. Organizations with multiple physical office locations must purchase a separate account for each location. Sharing login credentials, passwords, or account access by any means — including allowing another individual to use your active session or device — is strictly prohibited. All users under an account must be employees of the organization associated with that account. Sharing account access with subcontractors, clients, consultants, or any individual outside of your organization is strictly prohibited. Remote workers are not automatically covered under any office account and must be arranged on a case-by-case basis by contacting Amtek Information Services, Inc. directly at support@amtekusa.com. If you become aware of any unauthorized access to or use of your account, you must notify Amtek Information Services, Inc. immediately at support@amtekusa.com. Any violation of these provisions may result in immediate termination of your account.
You agree not to engage in any of the following prohibited activities: (i) copying, downloading, screenshotting, distributing, or disclosing any AmtekPro Data or any part of the AmtekPro platform in any medium, in whole or in part, including without limitation by any automated or non-automated "scraping"; (ii) using any automated system, including without limitation "robots," "spiders," "offline readers," or any data extraction or harvesting tools of any kind; (iii) transmitting spam, chain letters, or other unsolicited email; (iv) attempting to interfere with or compromise the system integrity or security, or decipher any transmissions to or from the servers running AmtekPro; (v) taking any action that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure, at our sole discretion; (vi) uploading invalid data, viruses, worms, or other software agents through AmtekPro; (vii) collecting or harvesting any personally identifiable information, including without limitation account names, from AmtekPro; (viii) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, or hiding or attempting to hide your identity; (ix) interfering with the proper working of AmtekPro; (x) reverse engineering, decompiling, or otherwise attempting to derive the structure, methodology, or proprietary processes underlying AmtekPro or its data; (xi) using AmtekPro Data for any commercial purpose, including incorporation into any product, platform, or service offered to third parties, except as expressly permitted under a separate Commercial Use License Agreement with Amtek Information Services, Inc.
All data, reports, bid tabulations, cost information, project records, and other content available through AmtekPro (collectively, "AmtekPro Data") are the exclusive proprietary property of Amtek Information Services, Inc. AmtekPro Data is gathered, compiled, verified, and maintained through substantial investment of time, labor, and resources by Amtek Information Services, Inc.
Your subscription to AmtekPro grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access, view, print, and export AmtekPro Data solely for your own internal business purposes. Permitted internal uses include, but are not limited to, reviewing bid results, analyzing competitor pricing, researching unit prices, and assessing market values. Printed or exported reports are subject to the same use restrictions as digital data and may not be shared outside your organization or used for any prohibited purpose described herein.
This license does not permit any of the following without prior written authorization and execution of a separate Commercial Use License Agreement with Amtek Information Services, Inc.:
(i) Reselling, redistributing, sublicensing, or otherwise transferring AmtekPro Data, in whole or in part, to any third party; (ii) Incorporating AmtekPro Data into any software application, platform, tool, or service — including without limitation any SaaS product, estimating tool, cost modeling application, or AI/machine learning system — whether offered commercially or otherwise; (iii) Using AmtekPro Data as a dataset, training set, reference database, or component of any product or service made available to third parties; (iv) Aggregating, reformatting, or repurposing AmtekPro Data in a manner that replicates or competes with AmtekPro's functionality; (v) Storing AmtekPro Data in any external database, repository, or content management system beyond what is reasonably necessary for internal business use; (vi) Retaining, using, or distributing AmtekPro Data in any form following the termination or expiration of your subscription.
Any use of AmtekPro Data beyond the scope of the limited license described above constitutes a material breach of these Terms of Service and may subject you to immediate account termination, injunctive relief, and claims for damages. By accepting these Terms of Service, you agree not to infringe upon any intellectual property owned by Amtek Information Services, Inc. or any third party.
AmtekPro and its content are protected by copyright, trademark, and other such laws of both the United States and foreign countries. The compilation, arrangement, presentation, and ongoing maintenance of AmtekPro Data represents a substantial investment of time, labor, and resources by Amtek Information Services, Inc. and constitutes proprietary work product and an original work of authorship protected under applicable copyright law. Amtek Information Services, Inc. retains all right, title, and interest in and to AmtekPro Data, including all intellectual property rights therein, regardless of the form in which such data is accessed, viewed, printed, or exported by the user. No ownership rights in AmtekPro Data are transferred to the user by virtue of a subscription or any permitted use under these Terms.
Nothing in these Terms of Service shall be construed to grant any implied license, right, or interest in AmtekPro, AmtekPro Data, or any intellectual property owned by Amtek Information Services, Inc. beyond the limited license expressly stated herein. Except as expressly provided in these Terms of Service, nothing in these Terms of Service gives you a right to use the AmtekPro name or any of the AmtekPro trademarks, logos, domain names, and other distinctive brand features.
By accepting these Terms of Service, you agree to indemnify, defend, and hold harmless Amtek Information Services, Inc. and its officers, directors, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) that may arise from: (i) your use of AmtekPro; (ii) your violation of these Terms of Service; (iii) any unauthorized use, redistribution, or commercial exploitation of AmtekPro Data by you or any party gaining access through your account; or (iv) any claim by a third party arising out of or related to your use of AmtekPro Data beyond the scope of the limited license granted herein.
Under no circumstances shall Amtek Information Services, Inc. be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use AmtekPro, including but not limited to reliance by a user on any information obtained from AmtekPro. This includes, without limitation, mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance. The limitation of liability applies whether the claims are based on contract, tort (including negligence), strict liability, or any other legal theory, even if Amtek Information Services, Inc. has been advised of the possibility of such damages. To the fullest extent permitted by applicable law, Amtek Information Services, Inc. expressly disclaims all liability of any kind arising out of or related to your use of AmtekPro.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. By accepting these Terms of Service, you consent to the exclusive jurisdiction of the state courts of Harris County, Texas and the United States District Court for the Southern District of Texas for the resolution of any dispute arising out of or relating to these Terms of Service or your use of AmtekPro. You hereby waive any objection to the laying of venue in Harris County, Texas or the Southern District of Texas, and waive any claim that such courts represent an inconvenient forum. This provision establishes a clear legal framework for addressing any potential issues and ensures fair and consistent dispute resolution.
AmtekPro and its content are provided "as is" and on an "as available" basis without any representations or warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Amtek Information Services, Inc. does not warrant that the service will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components. Further, the company makes no representations as to the operation of AmtekPro or the information, content, materials, or products included on AmtekPro.
AmtekPro Data is gathered from a variety of sources, including but not limited to public records, newspapers, bid boards, and self-reported contractor data. Amtek Information Services, Inc. makes no representations or warranties as to the accuracy, completeness, timeliness, or reliability of any AmtekPro Data, regardless of its source. Amtek Information Services, Inc. is not responsible for any errors, omissions, or inaccuracies in AmtekPro Data that originate from third-party sources, public records, or self-reported information. All data is provided for informational purposes only and should be independently verified before being relied upon for any business decision.
You agree that your use of AmtekPro and any reliance on AmtekPro Data is entirely at your own risk. Amtek Information Services, Inc. expressly disclaims any and all liability for business decisions, financial outcomes, bid results, or any other consequences arising from your use of or reliance on AmtekPro Data. It is your sole responsibility to independently evaluate the accuracy and suitability of any information obtained through AmtekPro before acting upon it.
Each AmtekPro account is limited to a maximum of three users and is tied to a single physical office location, as described in the User Account, Password Security, and Account Sharing section of these Terms. Each user must have their own unique login credentials and must be an employee of the organization associated with that account.
Each individual user is permitted to access AmtekPro on up to two devices simultaneously, for a maximum of six concurrent active sessions per account. These device limits are per user and are not transferable between users on the same account.
If you require additional users or device access beyond these limits, this may be arranged on a case-by-case basis by contacting Amtek Information Services, Inc. directly at support@amtekusa.com. It is the account holder's responsibility to ensure that the number of users and devices in use under their account complies with these Terms of Service at all times. Any unauthorized use of additional users or devices in excess of these limits may result in immediate termination of your account.
Neither party shall be liable to the other for any delay or failure in performance under these Terms of Service arising out of a cause beyond its control and without its fault or negligence. Such causes may include but are not limited to natural disasters, wars, terrorist acts, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, cyberattacks, ransomware or malware incidents, internet or telecommunications outages, or failures of third-party infrastructure or service providers upon which AmtekPro relies.
In the event that a force majeure event occurs, the affected party shall notify the other party as soon as reasonably practicable, describing the nature of the event and its anticipated impact on performance. Both parties shall make reasonable efforts to mitigate the effects of the force majeure event and resume normal operations as quickly as possible.
These Terms of Service, together with any Privacy Policy, Commercial Use License Agreement, or other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Amtek Information Services, Inc. concerning the use of AmtekPro and supersede all prior and contemporaneous agreements, understandings, negotiations, and representations between the parties, whether written or oral, relating to the subject matter herein.
If any provision of these Terms of Service is deemed invalid or unenforceable by a court of competent jurisdiction, such provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
The failure of Amtek Information Services, Inc. to enforce any right or provision of these Terms of Service at any time shall not be construed as a waiver of that right or provision, nor shall it affect the right of Amtek Information Services, Inc. to enforce such right or provision at any time thereafter. No waiver of any provision of these Terms shall be effective unless made in writing and signed by an authorized representative of Amtek Information Services, Inc.
Amtek Information Services, Inc. reserves the right to modify or discontinue, temporarily or permanently, AmtekPro or any service to which it connects, at any time and without notice, and without liability to you. This includes changes to the features, user interfaces, pricing, subscription fees, and any content or data available through AmtekPro. Amtek Information Services, Inc. further reserves the right to modify these Terms of Service at any time and without prior notice. Updated Terms will be posted on AmtekPro and will be effective immediately upon posting.
You are solely responsible for regularly reviewing AmtekPro and these Terms of Service for any updates or changes. Your continued use of AmtekPro following any modification to the service, pricing, or these Terms of Service constitutes your acceptance of such changes. If you do not agree to any modified terms or pricing, your sole remedy is to cancel your subscription in accordance with the Cancellations section of these Terms.
Termination by Amtek Information Services, Inc.: We reserve the right, in our sole discretion, to terminate or suspend your access to AmtekPro, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users of AmtekPro, us, or third parties, or for any other reason. Suspension may be implemented as an intermediate step prior to termination, at the sole discretion of Amtek Information Services, Inc. In the event of termination for cause, including but not limited to violation of the data use restrictions set forth in these Terms, no refund of any kind will be issued for any unused portion of the current subscription period.
Termination by User: Users may terminate their accounts at any time by contacting our support team at support@amtekusa.com. Termination will be effective immediately upon processing by Amtek Information Services, Inc.
Obligations Upon Termination: Upon termination of your account for any reason, your license to access and use AmtekPro and AmtekPro Data is immediately revoked. You must immediately cease all use of AmtekPro Data and destroy or delete any AmtekPro Data retained in any form, including printed reports, exported files, or any other copies, whether digital or physical. Amtek Information Services, Inc. reserves the right to verify compliance with this obligation upon request.
Survival: The following sections of these Terms of Service shall survive the termination or expiration of your account for any reason: Proprietary Data and Restricted Use of AmtekPro Content, Intellectual Property Protection and Proprietary Rights, Indemnification and Limitation of Liability, Governing Law and Jurisdiction, Arbitration Agreement, and Consequences of Breach.
Amtek Information Services, Inc. does not offer refunds for any unused portion of the current subscription month, regardless of the reason for cancellation or termination, whether initiated by the user or by Amtek Information Services, Inc. All subscription fees are non-refundable once billed on the first of the calendar month. By subscribing to AmtekPro, you acknowledge and agree to this no-refund policy. Your sole remedy for dissatisfaction with AmtekPro or these Terms of Service is to cancel your subscription in accordance with the Cancellations section of these Terms.
By accepting these Terms of Service, both you and Amtek Information Services, Inc. agree to resolve any dispute by individual arbitration. This means that neither party shall start or proceed upon any class action lawsuit, class-wide arbitration, or any other representative action or proceeding.
Should a dispute arise concerning the terms, breach of terms, or use of AmtekPro, the party raising the dispute shall notify the other immediately in writing, and both parties shall make a good faith effort to resolve the issue informally within thirty (30) days of such notice. If the dispute cannot be resolved informally within that period, both parties agree to settle the dispute through binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its then-current Commercial Arbitration Rules. The arbitration shall take place in Harris County, Texas. The arbitrator's decision shall be final and binding on both parties and may be entered as a judgment in any court of competent jurisdiction.
Any claim or dispute arising out of or relating to these Terms of Service or your use of AmtekPro must be brought within one (1) year of the date on which the claim arose, or such claim shall be permanently barred.
This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these Terms, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms.
Notwithstanding the foregoing, Amtek Information Services, Inc. reserves the right to seek emergency injunctive or other equitable relief in any court of competent jurisdiction without first engaging in arbitration or the informal dispute resolution process described above, where such relief is necessary to protect its proprietary data, intellectual property rights, or other interests that may be subject to immediate and irreparable harm. The pursuit of such relief shall not be deemed a waiver of Amtek Information Services, Inc.'s right to compel arbitration for any remaining claims.
Any breach of these Terms of Service, including but not limited to unauthorized use of AmtekPro, unauthorized sharing or redistribution of AmtekPro Data, or unauthorized commercial exploitation of AmtekPro Data — including its incorporation into any software, platform, tool, or service offered to third parties — may result in any or all of the following: immediate suspension or termination of your account without notice or refund; legal action against the offending user; and/or any other remedies available under applicable law.
In the event of a breach or suspected breach of these Terms, Amtek Information Services, Inc. reserves the right to investigate the suspected violation, including reviewing account activity, access logs, and usage patterns, without prior notice to the user. You agree to cooperate fully with any such investigation upon request.
In the event that Amtek Information Services, Inc. pursues legal action arising from a breach of these Terms, it may seek any and all available remedies, including but not limited to actual damages, disgorgement of any profits derived from the unauthorized use of AmtekPro Data, statutory damages where applicable, emergency and permanent injunctive relief, and recovery of all reasonable attorney's fees, court costs, and other legal expenses incurred in connection with such action.
The remedies set forth in this section are cumulative and not exclusive of any other rights or remedies available to Amtek Information Services, Inc. at law or in equity. Amtek Information Services, Inc. reserves the right to take any and all action it deems necessary to protect its rights, its proprietary data, and the rights of its users.
AmtekPro may feature links to third-party websites or services not owned or overseen by Amtek Information Services, Inc. The inclusion of any third-party link on AmtekPro does not imply endorsement, approval, or affiliation by Amtek Information Services, Inc. with the linked site or its operators. Amtek Information Services, Inc. does not endorse or assume responsibility for the content, accuracy, privacy policies, or practices of any third-party websites or services, and makes no representations or warranties regarding any third-party site or its content.
When you leave AmtekPro and visit a third-party site, you are subject to that site's own terms of service and privacy policies, not those of Amtek Information Services, Inc. We strongly encourage you to review the terms and privacy policies of any third-party site you visit. Amtek Information Services, Inc. has no control over and assumes no responsibility for the availability, accuracy, or continued operation of any third-party links featured on AmtekPro, and reserves the right to remove or modify any third-party link at any time without notice.
You acknowledge and agree that Amtek Information Services, Inc. is not liable, directly or indirectly, for any damage or loss resulting from your use of or reliance on any content, products, or services available through any third-party site linked from AmtekPro.
AmtekPro operates on a month-to-month subscription basis. Subscriptions automatically renew on the first of each calendar month unless cancelled in accordance with the Cancellations section of these Terms. Subscribers are billed on the first of each calendar month either by automatic charge to the payment method on file or by invoice, depending on the billing arrangement established with Amtek Information Services, Inc. at the time of account setup. Subscribers are not bound by long-term contracts but are responsible for ensuring their subscription is cancelled in a timely manner if they no longer wish to be charged.
Subscription fees are subject to change at any time in accordance with the Modifications to the Service and Terms section of these Terms. Your continued use of AmtekPro following any pricing change constitutes your acceptance of the updated subscription fees. It is your responsibility to regularly review your subscription terms and any notices posted on AmtekPro regarding pricing updates.
Subscription fees are billed monthly on the first of each calendar month. Depending on your billing arrangement with Amtek Information Services, Inc., you will either be charged automatically to your payment method on file or issued an invoice by mail or email. Invoices are due and payable immediately upon receipt. You are responsible for ensuring that your payment information or billing details on file with Amtek Information Services, Inc. are accurate and up to date at all times.
In the event that a payment is declined, fails, or an invoice remains unpaid, Amtek Information Services, Inc. reserves the right to revoke your access to AmtekPro at its sole discretion and without prior notice. Amtek Information Services, Inc. does not automatically retry failed payments. Revocation of access due to non-payment does not constitute termination of your account or your obligations under these Terms of Service.
If your access has been revoked due to non-payment, you may contact Amtek Information Services, Inc. at support@amtekusa.com or by phone at 281-376-4577 to resolve your outstanding balance and provide updated payment information. Upon receipt and processing of a valid payment, Amtek Information Services, Inc. may, at its sole discretion, reinstate your access to AmtekPro. No reinstatement fee will be charged. Amtek Information Services, Inc. makes no guarantee as to the timeliness of reinstatement and shall not be liable for any loss or inconvenience resulting from a period of suspended access due to non-payment.
Users may cancel their account at any time by contacting our support team at support@amtekusa.com. To avoid being charged or invoiced for the next month, you must submit your cancellation request at least 10 days before the end of the current calendar month, meaning no later than the 21st of the month. Cancellation requests submitted fewer than 10 days before the end of the current calendar month may result in renewal and a charge or invoice for the subsequent month.
Upon cancellation, you will retain access to AmtekPro through the end of your current paid calendar month. Access will be terminated at the conclusion of that period. No refund will be issued for any unused portion of the current month or for any prior subscription periods, in accordance with the Refunds section of these Terms.
Cancellation of your account does not release you from your obligations under these Terms of Service with respect to AmtekPro Data. Upon the conclusion of your final billing month, you remain bound by the data use restrictions, termination obligations, and all other provisions that survive termination as set forth in the Termination of Service section of these Terms.
Amtek Information Services, Inc. reserves the right to update or modify these Terms of Service at any time without prior notice, as described in the Modifications to the Service and Terms section of these Terms. Updated Terms will be posted on AmtekPro and will be effective immediately upon posting. You are solely responsible for regularly reviewing these Terms of Service for any changes or updates. We recommend reviewing these Terms at least once per month to ensure you are aware of any modifications.
By continuing to use AmtekPro following the posting of any updated Terms, you acknowledge and agree to be bound by the most recent version of these Terms of Service. If you do not agree to any updated Terms, your sole remedy is to cancel your subscription in accordance with the Cancellations section of these Terms.
